Parking Fines

Private parking charges (on private land) and council penalty charge notices (PCNs, on public roads) are different things with different appeal routes. Private charges are an invoice for an alleged breach of contract, while council PCNs are statutory penalties with a free independent tribunal.

Private Parking Charges

  • Different Tickets, Different Appeals

    Appeal rights differ by type of ticket: private parking charge, council PCN and police fixed penalty notice each have a different route (Citizens Advice overview). source

  • Appealing to the Operator, Then POPLA

    Private parking charge: you can appeal to the operator first, then to POPLA (BPA members) or the Independent Appeals Service (IPC members) for free; while a POPLA appeal is open the operator must not pursue you for payment. source

  • POPLA Time Limit

    POPLA appeals must be made within 28 days of the operator rejecting your appeal, using the verification code the operator gives you; you cannot go to POPLA directly. source

  • Keeper Liability

    Keeper liability (England and Wales only): under Protection of Freedoms Act 2012 Schedule 4 the operator can only pursue the registered keeper if it follows strict notice rules. A notice to keeper must arrive within 14 days of the parking if no ticket was left on the car, or within a set window after the 28-day period following a ticket left on the car; the keeper then has 28 days to pay before liability arises. source

  • Hire Vehicles

    Hire vehicles: Schedule 4 (para 13) means the operator cannot recover from the hire company if, within 28 days of the keeper notice, it supplies the hire agreement and the hirer's signed acceptance of liability; the operator may then pursue the hirer. source

  • Scotland and Northern Ireland

    Scotland and Northern Ireland have no automatic keeper liability for private parking charges, so a keeper who was not driving is not automatically liable there. source

Council Parking Tickets

  • Challenging a Council Ticket

    Council PCN (England outside London and Wales): make representations to the council within 28 days; if rejected you get a Notice of Rejection and have 28 days to appeal to the Traffic Penalty Tribunal, which is free and mostly online. You can only appeal to the tribunal after making representations to the council. source

  • The 50% Discount

    Council PCNs are normally reduced by 50% if paid within the discount period (14 days; some PCN types 21), and the discount is usually kept open while representations are pending. source

Steps to Take

Step 1 of 7

Identify what you have: a private Parking Charge Notice (PCN-style letter from a company), a council Penalty Charge Notice, or a police fixed penalty. Check the issuer and which trade body (BPA or IPC) the private operator belongs to.

Step 2 of 7

Do not ignore it and do not pay in a panic: paying a private charge may end your appeal rights. Note every date on the notice and when you received it.

Step 3 of 7

Gather evidence: photos of signs, lines and the machine, payment or permit proof, Blue Badge, receipts, and any breakdown or medical evidence.

Step 4 of 7

Appeal to the issuer first (the operator or the council) in writing, stating why the charge is invalid or unfair. For a council PCN, do this inside the 28-day / discount period if you can.

Step 5 of 7

Private parking: if the operator rejects your appeal, use the verification code to appeal to POPLA (28 days) or the IAS (see Citizens Advice for IAS timing) for free.

Step 6 of 7

Council PCN: if rejected, appeal to the Traffic Penalty Tribunal within 28 days of the Notice of Rejection (England outside London and Wales), using the PIN on the notice.

Step 7 of 7

If you lose and still disagree, check whether the debt can be challenged in court, and do not ignore later letters or court papers; get free advice from Citizens Advice.

Watch Out For

Common traps and scams to avoid.

Paying a private charge early can forfeit your right to appeal to POPLA or IAS.

Letters from debt collectors and solicitors on behalf of private operators are not court orders; check whether the original notice complied with the keeper-liability rules before paying extra fees.

Claims management and 'appeal for a fee' services are unnecessary: POPLA, IAS and the Traffic Penalty Tribunal are free to use.

Mixing up ticket types: a council PCN must be challenged with the council, not a private operator route, and vice versa.

Recent or changing rules: tap to read

The statutory Private Parking Code of Practice under the Parking (Code of Practice) Act 2019 is NOT yet in force as far as could be verified: a code published in Feb 2022 was withdrawn in June 2022; DLUHC/MHCLG consulted 11 July to 26 September 2025 on charge caps (100 pounds), debt-recovery fees (70 pound cap under review), appeals and certification; a House of Commons Library briefing dated 7 April 2026 says the government had not yet responded or set an implementation date. A voluntary industry Single Code of Practice (BPA and IPC) has applied since 1 October 2024 for new sites with existing sites to comply later (Which? says by late 2026); it includes a 10-minute grace period at the end of a stay and a 100 pound cap with at least a 40% early-payment discount as described in the Commons Library briefing. Re-check gov.uk for any government response after April 2026.
